Terms of Service

Welcome to Theme Park Patch Notes. These Terms of Service (the “Terms”) govern your use of the Theme Park Patch Notes Discord bot, our Discord community server, and the website at themeparkpatchnotes.com (together, the “Service”). Please read them carefully. By adding our bot to a server, joining our community, or using the website, you agree to these Terms. If you do not agree, please do not use the Service.

1.About the Service

Theme Park Patch Notes is a free, fan-made hobby project. It documents small, often-overlooked updates to theme-park attractions — such as effects coming back online, scene changes, new audio, refurbishments, and ride downtime or returns — and presents them like software “patch notes,” with a page for each attraction. The Service also surfaces community-reported and aggregated information such as wait times and ride status. The Service is provided free of charge.

2.Not Affiliated With Any Park or Brand

Theme Park Patch Notes is an independent fan project. It is not affiliated with, authorized by, endorsed by, or sponsored by The Walt Disney Company, Universal Destinations & Experiences, NBCUniversal, or any other theme-park operator, resort, or rights holder. All attraction names, park names, logos, characters, and related trademarks are the property of their respective owners and are used here only for the purpose of identification, commentary, and reference (nominative fair use). No ownership or affiliation is claimed or implied.

3.Eligibility

You must be at least 13 years old (or the minimum age required to use Discord in your country, if higher) to use the Service. By using the Service you represent that you meet this requirement. Because the Service operates through Discord, your use is also subject to Discord’s Terms of Service and Community Guidelines.

4.Your Account

The Service authenticates you through your Discord account; we do not create a separate password-based login. You are responsible for activity that occurs through your account and for keeping your Discord credentials secure. You may stop using the Service at any time by leaving the community, removing the bot, or no longer using the website.

5.Acceptable Use

When using the Service, you agree not to:

Submit information you know to be false, misleading, or intentionally inaccurate (including fake update reports or status changes);
Harass, abuse, threaten, or harm other users;
Post content that is unlawful, hateful, sexually explicit, or otherwise violates Discord’s Community Guidelines;
Spam, flood, or disrupt the Service, or attempt to manipulate reports, contributor leaderboards, or other features;
Attempt to gain unauthorized access to the Service, its data, or its underlying systems, or interfere with their normal operation;
Use the Service to violate any applicable law or the rights of others.

6.User Contributions

The Service lets you contribute content such as update reports, effect and change notes, comments, and similar submissions (“Contributions”). You retain ownership of your Contributions. By submitting a Contribution, you grant Theme Park Patch Notes a worldwide, non-exclusive, royalty-free license to store, display, reproduce, adapt, and distribute that Contribution as part of operating and promoting the Service (for example, posting a reported update to a patch-notes feed or attraction page).

You represent that you have the right to submit your Contributions and that they do not violate these Terms or the rights of any third party. We are not obligated to publish, keep, or store any Contribution, and we may review, moderate, edit, or remove Contributions — and the information derived from them — at our discretion and without notice.

7.Accuracy and No Reliance

Wait times, ride status, operating information, and update reports are community-sourced and/or aggregated from third parties. They may be incomplete, delayed, or inaccurate. Do not rely on the Service for trip planning, safety, accessibility, or other important decisions. Always confirm details with the official park or operator.

8.Intellectual Property

Except for third-party trademarks (see Section 2) and user Contributions (see Section 6), the Service — including its original text, software, design, branding, and curated content — is owned by Theme Park Patch Notes and is protected by applicable intellectual-property laws. You may not copy, resell, or create derivative works from the Service except as permitted by these Terms or applicable law.

9.Third-Party Services and Links

The Service depends on and links to third-party services and sources, including Discord and publicly available theme-park news and data sources. We do not control those services and are not responsible for their content, availability, terms, or privacy practices. Your use of any third-party service is governed by that service’s own terms.

10.Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any information it provides is accurate or current.

11.Limitation of Liability

To the fullest extent permitted by law, Theme Park Patch Notes and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Service. Because the Service is provided free of charge, our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US $100).

12.Indemnification

You agree to indemnify and hold harmless Theme Park Patch Notes and its operator from any claims, damages, or expenses arising out of your Contributions, your use of the Service, or your violation of these Terms or the rights of any third party.

13.Suspension and Termination

We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, including for any violation of these Terms or Discord’s rules. We may also modify or discontinue the Service, in whole or in part, at any time. You may stop using the Service at any time.

14.Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes may also be announced in our community server. Your continued use of the Service after changes take effect means you accept the updated Terms.

15.Governing Law

These Terms are governed by the laws of the United States and the state in which the operator of the Service resides, without regard to conflict-of-law principles. Any dispute relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located there.
